1. Agreement to Terms

By accessing or using MooseTrader.com (“the Service”), operated by TownWebsite.com (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MooseTrader is an online platform that facilitates communication between holders of Maine moose hunting permits who wish to exchange permits with other holders. The Service provides tools for listing permits, searching for potential swap partners, communicating through our messaging system, and generating swap documentation.

MooseTrader does not buy, sell, broker, or transfer moose permits. We provide a communication platform. All swap arrangements are made directly between permit holders. We do not guarantee that any swap will be completed, approved by the Maine Department of Inland Fisheries & Wildlife (IFW), or result in a satisfactory outcome for either party.

3. Maine IFW Compliance

MooseTrader's revenue is derived from flat seasonal membership fees, not from per-swap commissions or success fees. Our fee structure is designed to comply with Maine IFW regulations regarding moose permit exchanges. Specifically, we do not “directly receive compensation or something of value solely as part of an exchange of moose permits” as defined by Maine law.

Users are responsible for ensuring their own compliance with all applicable Maine IFW rules and regulations regarding moose permit swaps. MooseTrader does not provide legal advice regarding the legality of any specific swap arrangement.

4. Membership and Fees

Basic features (account creation, Winner Watch alerts, permit search, bonus points calculator) are provided free of charge.

A seasonal membership fee of $34.95 is required to initiate contact with other permit holders through our messaging system. This fee covers the entire 2026 moose swap season and allows the member to respond to unlimited listings. Membership fees are non-refundable once a message has been sent through the platform.

Listing a permit for swap on the marketplace is free. No additional fees are charged for completing a swap.

5. Escrow and Financial Transactions

MooseTrader offers optional escrow protection for swaps that involve a cash component. Escrow services are provided by third-party payment processors (PayPal Goods & Services or Escrow.com) and are governed by those providers' own terms of service.

MooseTrader does not hold, process, or manage any funds between users. All financial transactions occur directly through third-party payment processors. MooseTrader is not responsible for payment disputes, chargebacks, holds, or any financial loss arising from transactions between users.

Users who choose to transact without escrow protection do so entirely at their own risk. MooseTrader strongly recommends using escrow for any swap involving cash or items of value.

6. Swap Contracts and Documentation

MooseTrader provides tools to generate swap agreement documents between users. These documents are intended to help organize and memorialize the terms agreed upon by both parties. They are not legal contracts prepared by an attorney and should not be relied upon as a substitute for independent legal advice.

Both parties are solely responsible for reviewing and agreeing to the terms of any swap. MooseTrader does not verify, enforce, or guarantee the terms of any agreement between users. The official IFW Moose Permit Swap Application must still be completed and submitted to the Maine Department of Inland Fisheries & Wildlife by both permit holders.

7. User Conduct

You agree not to:

  • Provide false or misleading information about your identity or permit status
  • Post listings for permits you do not hold or are not authorized to swap
  • Share personal contact information (phone numbers, email addresses, social media) through the messaging system to circumvent the platform
  • Offer illegal items, controlled substances, or anything prohibited by law as part of a swap
  • Harass, threaten, or abuse other users
  • Create multiple accounts to circumvent platform rules or fees
  • Attempt to reverse-engineer, scrape, or interfere with the operation of the Service

Violation of these terms may result in immediate account suspension or termination without refund.

8. Limitation of Liability

MooseTrader, TownWebsite.com, and their owners, officers, employees, and agents shall not be held liable for any damages, losses, disputes, or claims arising from:

  • Any swap arrangement between users, whether completed or not
  • The accuracy of permit information provided by users
  • The identity, conduct, or trustworthiness of any user
  • Non-delivery of goods, services, or payments promised as part of a swap
  • Rejection of a swap by Maine IFW for any reason
  • Technical errors, downtime, or data loss

Our total liability to any user shall be limited to the amount of fees actually paid by that user to MooseTrader, and in no case shall exceed $34.95.

9. Dispute Resolution

MooseTrader is a communication platform and is not a party to any swap agreement between users. We are not attorneys, mediators, or arbitrators. We cannot and do not provide legal advice. Users should consult with their own legal counsel before entering into any swap agreement.

In the event that MooseTrader or its representatives are required to appear in court, provide testimony, or produce records in connection with a dispute between users, the disputing parties shall be jointly and severally liable for:

  • A fee of $600 per day for any required court appearances or depositions
  • Travel expenses at a rate of $2.00 per mile
  • All associated legal costs, attorney fees, and expenses incurred by MooseTrader

These Terms shall be governed by and construed in accordance with the laws of the State of Maine. Any legal action arising from these Terms or use of the Service shall be brought exclusively in the courts of the State of Maine.

Before initiating any legal action, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days. If the dispute cannot be resolved through negotiation, either party may elect binding arbitration administered under the rules of the American Arbitration Association, conducted in Penobscot County, Maine. The arbitrator's decision shall be final and binding.

10. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct that we determine to be harmful to other users or the Service. In the event of account termination:

  • You will be notified via the email address associated with your account
  • You may request a review of the decision by contacting [email protected] within 14 days
  • Membership fees are non-refundable for accounts terminated due to Terms violations
  • Any pending swap agreements will be cancelled and the other party notified

You may voluntarily close your account at any time by contacting us. Upon account closure, your personal information will be handled in accordance with our Privacy Policy.

11. Indemnification

You agree to indemnify, defend, and hold harmless MooseTrader, TownWebsite.com, and their owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or any swap arrangement you enter into through the platform.

12. Privacy and Data

Your use of the Service is also governed by our Privacy Policy. We collect and use personal information as described therein. All messages sent through the platform are logged and retained for safety, dispute resolution, and compliance purposes.

13. Communication Consent

By creating an account, you consent to receive transactional emails from MooseTrader (verification codes, Winner Watch alerts, swap notifications). You may opt in to receive marketing communications (newsletters, gear deals, lottery reminders). You may unsubscribe from marketing emails at any time via the unsubscribe link in each email. Transactional emails related to your account cannot be opted out of while your account is active.

14. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered users. Continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
